APPLICATION U/S 14 OF THE SINDH RENTED PREMISES ORDINANCE 1979 


The Applicant respectfully prays as under: 

1. That the Applicant is a respectful and law-abiding citizen of Pakistan and is the owner / landlord of Flat No. A-21, Sunview Terrace, Block IV, Gulshan Iqbal Karachi (hereinafter referred to as the “subject premises”). 

2. That the Applicant and the Opponent entered into a tenancy agreement in February, 2009 in respect of the subject premises at the rate of Rs. 12, 000/- (Rupees Twelve Thousand Only) exclusive of utility bills and a deposit of Rs. 50, 000/- (Rupees Fifty Thousand Only) was also paid. It is submitted that the agreement was renewed from time to time. The monthly rent of the subject premises was payable in advance on or before the 10th day of every English calendar month. Of relevance here is also the fact that prior to the execution of the agreement, the Applicant informed the Opponent through a letter that she would need the subject premises for her personal use by 2012 as she would be retiring in the same year.

3. That the Applicant, being an employee in a private bank, rented out the premises as the nature of her service was such that she was required to be transferred to various parts of the country; and, pursuant to the execution of the tenancy agreement, she was transferred to Lahore by her employer. 4. That the service of the Applicant ended in January, 2012 by way of retirement, following which, she returned back to Karachi and is currently residing at her sister’s residence.

5. That, on 10/02/12, the Applicant served the statutory notice to the Opponent as contemplated in Section 14 of the Sindh Rented Premises Ordinance, 1979, informing him that she needed the subject premises for her personal use as she had retired from her service, that she did not own any other accommodation where she could reside and requested him to deliver up vacant and peaceful possession of the same.

HOW TO WRITE AN APPLICATION U/S 14 OF THE SINDH RENTED PREMISES ORDINANCE 1979?

6. That the cause of action arose to the Applicant, when the Applicant retired from her service and when the statutory period of two months mentioned in the Ordinance expired. 7. That for the purposes of Court fee and jurisdiction, the proper court fee is affixed thereon. The premises being within P. S. ______________________, this Hon’ble Court has the jurisdiction to entertain this Application. 

PRAYER 

The Applicant respectfully prays that this Hon’ble Court may be pleased to: 

a. Pass an order directing the Opponent to hand over peaceful and vacant possession of the said premises to the Applicant; 

b. Grant any other further and/or better relief that this Hon’ble Court may deem fit and proper, under the prevalent circumstances. 

c. Costs of the Application.
