APPLICATION U/S 10 (3) OF THE SINDH RENTED PREMISES ORDINANCE, 1979 

The Applicant respectfully submits as follows: 

1. That the Applicant is a law-abiding citizen of Pakistan and is a doctor by profession and the Opponent is the landlady/owner of Bungalow No. 112- D, Phase V, Nursery, P. E. C. H. S., Karachi, admeasuring 240 square yards (hereinafter referred to as the “said premises”). The Applicant is residing at the said premises as well as running a private dental clinic. It is submitted that the current rate of rent is fixed at Rs. 50, 000/- payable on the 10th of each calendar month, which does not include any utility bills. 

2. It is submitted that the Opponent acquired the said premises from the previous property owner/owner by virtue of a gift deed in 2004. Since that time, the Opponent has been continuously demanding enhancement of rent, which has during the course of the years multiplied, and thus, the current rate is Rs. 50, 000/- (Rupees Fifty Thousand Only) payable on the 10th of every calendar month. 

3. That the Applicant has always tendered the payment of rent personally or through pay orders. It is submitted that when the Applicant went to the Opponent’s clinic to tender the payment of rent for the month of April, 2010 on the 9th, the Opponent refused to accept the payment of rent. Instead, she demanded a 40% enhancement in the monthly rent. Thereafter the Applicant preferred to tender the monthly rent through pay orders, which was also refused by the Opponent unsurprisingly. (Photocopy of the pay order is attached herewith and marked as Annexure “A-1”) 

4. That the cause of action arose to the Applicant in the month of April, 2010, when the Opponent refused the monthly rent for the month of April, 2010. 5. That for the purposes of court fee and jurisdiction, the proper court fee is affixed thereon. The premises being within P. S. ______________________, this Hon’ble Court has the jurisdiction to entertain this Application. 

PRAYER 

The Applicant respectfully prays that this Hon’ble Court may be pleased to: 

a. Permit and allow the Applicant to deposit the monthly rent of Rs. 50, 000/- for the month of April, 2010, and further be pleased to allow him to deposit subsequent monthly rent at the rate of Rs. 50, 000/- per month.

b. Grant any other further and/or better relief that this Hon’ble Court may deem fit and proper, under the prevalent circumstances.
